End User Privacy Policy

1. General

1.1The following Privacy Policy applies to the products and services provided by Cubbee Sleep Pty Ltd ACN 700 114 450.
1.2In this policy:
(a)Carer means a parent, guardian, family member, or other person with responsibility for a child's welfare who uses the Service, including to find or contact a Consultant;
(b)Consultant means an independent sleep consultant or other service provider who holds, or has applied for, a listing on the Service;
(c)Enquiry means a message or contact request submitted by a Carer through the Service for forwarding to a Consultant;
(d)Health Information has the meaning given in the Privacy Act 1988 (Cth) and includes information or an opinion about the health of an individual, including an illness, disability or injury;
(e)Personal Information has the meaning given in the Privacy Act 1988 (Cth);
(f)Sensitive Information has the meaning given in the Privacy Act 1988 (Cth) and includes Health Information; and
(g)the words we, our, us, Cubbee and Service refer to the Cubbee website at cubbee.com.au, any related Cubbee web or software application, and Cubbee Sleep Pty Ltd (ACN 700 114 450) and all of its related entities.
1.3This Privacy Policy applies to and should be read in conjunction with the Cubbee End User Terms (collectively, the Agreement).
1.4We are committed to protecting your privacy and complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
1.5We may amend, add or remove any part of this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Service or by other appropriate means.

2. Information That We Collect

2.1We collect information to provide the Service and to improve our products. We collect information in the following ways:
(a)Information you give to us directly. This includes:
(i)Enquiry information: the name, email address, and message content you provide when submitting an Enquiry to a Consultant; and
(ii)Communications: messages you send to us, including questions, feedback, and complaints.
(b)Information we collect through your use of the Service. This includes information collected by our server, from or about the computers, phones, or other devices where you access the Service, including the internet protocol (IP) address, approximate location derived from IP address, operating system, browser and platform, the pages you visit, your language settings, time zone, and referral source.
2.2The consultant-matching quiz is designed to operate without collecting Personal Information: the answers you select (such as your child's age range, sleep challenge, preferred approach, location, and budget) are used only to display matching Consultant listings, and no account or email address is required to use the quiz.
2.3If you do not provide the information we request, we may not be able to provide the Service to you, including forwarding your Enquiry to a Consultant.

3. Health and Sensitive Information

3.1If you choose to include Health Information or other Sensitive Information about yourself in communication, you consent to our collection and use of that information in accordance with this Privacy Policy, including its disclosure to the Consultant you have chosen to contact.
3.2If you provide Health Information or other information about a child, you:
(a)warrant that you are a parent, guardian, or person with lawful authority to provide that information and to consent to its collection, use, and disclosure on behalf of the child; and
(b)consent to that collection, use, and disclosure in accordance with this Privacy Policy.

4. How We Use Your Information

4.1We may use the information we collect to:
(a)forward Enquiries to the relevant Consultant, so the Consultant can respond to you directly;
(b)operate, maintain, protect, and improve the Service;
(c)send administrative communications, such as confirming that your Enquiry has been sent;
(d)respond to your enquiries, feedback, and complaints; and
(e)comply with legal obligations and enforce our terms and policies.
4.2We will not sell your Personal Information to third parties.
4.3We will not use Carer contact details for direct marketing without separate, explicit consent.

5. Disclosure of Your Information

5.1When you submit an Enquiry, we disclose your name, email address, and message content to the Consultant you have chosen to contact, either directly to their email or, where a direct email is not yet on file, by forwarding it to them via Cubbee, so the Consultant can respond to you. This is the core function of the Service and is necessary to provide the service you have requested.
5.2We do not disclose your contact details to any other Consultant, or make them visible to other Carers or the public.
5.3We rely on third-party service providers to operate the Service, each of which processes Personal Information on our behalf, including providers of:
(a)database hosting and storage;
(b)website hosting;
(c)transactional email delivery, including sending Enquiry notifications to Consultants and confirmation emails to Carers; and
(d)website analytics.
5.4We may also disclose Personal Information to:
(a)our legal, accounting, financial, or other professional advisors;
(b)regulatory or government authorities, law enforcement agencies, or other third parties where required by law or to protect our rights or the safety of users; and
(c)a purchaser or prospective purchaser in connection with any merger, acquisition, or sale of all or part of our business.

6. Cookies

6.1The Service uses cookies and similar technologies only as reasonably necessary to operate, protect, and improve the Service, including:
(a)authentication cookies, used to keep administrators and other authorised users signed in;
(b)temporary access cookies, used to grant access to restricted or unpublished content;
(c)security cookies, including cookies set by our hosting and payment providers, used to protect the Service against abuse and fraud; and
(d)analytics cookies and similar identifiers, used to understand how the Service is used and to improve it.

7. Security

7.1We use a number of security measures to protect the information you provide to us.
7.2We protect your Personal Information by:
(a)using encrypted transmission (HTTPS) across the Service;
(b)using access controls on our database;
(c)restricting internal and external access to your Personal Information to authorised personnel; and
(d)securely deleting or de-identifying Personal Information when it is no longer needed.
7.3While we take reasonable steps to protect your information, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
7.4If we become aware of a data breach that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme.

8. Data Retention

8.1We retain Personal Information for as long as necessary to fulfil the purposes described in this policy, or as required by law.
8.2Enquiry records are retained only for as long as they are reasonably needed for dispute resolution and service improvement, and are deleted or de-identified when no longer required.
8.3De-identified or aggregated data that cannot reasonably be used to identify you may be retained for analytics and service improvement purposes.

9. Access, Correction and Complaints

9.1You have the right to:
(a)request access to the Personal Information we hold about you;
(b)request correction of inaccurate, incomplete, or out-of-date Personal Information; and
(c)make a complaint about how we have handled your Personal Information.
9.2To exercise any of these rights, please contact us using the details below. We will respond within a reasonable period, generally within 30 days.
9.3If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

10. Cross Border Data Flows

10.1Some of the service providers referred to in clause 5 may store or process Personal Information outside Australia, including in the United States.
10.2Before disclosing Personal Information to an overseas recipient, we take reasonable steps to ensure that the recipient handles the information consistently with the Australian Privacy Principles, as required by Australian Privacy Principle 8.

11. Information About Children

11.1The Service is intended for use by adults (parents and carers) on behalf of themselves and their children. We do not knowingly collect Personal Information directly from children.
11.2Information about children provided by Carers is handled in accordance with clause 3, and we treat all information about children with particular care.
