End User Terms

1. Key Disclaimers

1.1Cubbee is a directory and referral platform that helps parents and carers find independent infant and child sleep consultants and related services in Australia.
1.2Cubbee is not a healthcare provider. Cubbee does not provide medical, health, or clinical advice, and nothing on the Service is a substitute for advice from a qualified health professional.
1.3Consultants listed on the Service are independent third parties. Cubbee does not employ, supervise, train, or manage any Consultant, does not endorse any Consultant, and is not a party to any agreement between you and a Consultant.
1.4If you think your child may have a medical emergency, call your doctor, go to the nearest hospital emergency department, or call 000 immediately.

2. General

2.1The following terms apply to the products and services provided by Cubbee Sleep Pty Ltd ACN 700 114 450.
2.2In this document:
(a)Carer means a parent, guardian, family member, or other person with responsibility for a child's welfare who uses the Service, including to find or contact a Consultant;
(b)Consultant means an independent sleep consultant or other service provider who holds a Listing on the Service;
(c)Content means all information, data, documents and creative expressions made accessible on or through the Service, and includes, without limitation, text, written posts, photographs, images, logos, credentials, pricing, availability, and business details;
(d)Enquiry means a message or contact request submitted by a Carer through the Service for forwarding to a Consultant;
(e)Listing means a Consultant's profile published on the Service;
(f)Service refers to the Cubbee website at cubbee.com.au and any related Cubbee web or software application;
(g)the words we, our, us and Cubbee refer to Cubbee Sleep Pty Ltd (ACN 700 114 450), the operator of the Service, and all of its related entities; and
(h)the words you and your mean you, the person accessing or using the Service.
2.3These End User Terms should be read in conjunction with, and you agree to, the:
(a)Cubbee Privacy Policy, which is available on the Service; and
(b)any supplementary terms agreed, or incorporated by reference, in the Service; (collectively, the Agreement).
2.4By using or accessing the Service, you agree to all the terms and conditions of the Agreement, and if you do not agree to all the terms and conditions of the Agreement you should not and are not permitted to use the Service.
2.5You must be at least 18 years of age to use the Service.

3. About the Service

3.1Cubbee provides an online directory and referral platform connecting Carers with Consultants, together with general educational content about infant and child sleep (0-5 years).
3.2The Service is provided free of charge to Carers browsing the directory, reading guides, taking the sleep quiz, and submitting Enquiries. Cubbee does not charge Carers for using the directory or contacting a Consultant, and does not take any commission on amounts you pay a Consultant.
3.3When you submit an Enquiry, we forward your name, email address, and message to the relevant Consultant, either directly to their email or, where a direct email is not yet on file, via Cubbee, so the Consultant can respond to you. The Cubbee Privacy Policy explains how this information is handled.
3.4A Listing may include enhanced or featured placement purchased by the Consultant. Where a Listing includes paid placement, it will be labelled as such on the Service. Paid placement affects only the position or prominence of a Listing, and is not an endorsement or ranking of quality by Cubbee.
3.5Any service you engage a Consultant to provide is a separate agreement solely between you and that Consultant. Cubbee is not a party to that agreement and has no responsibility for the quality, safety, legality, or outcome of any service provided by a Consultant.

4. Important Health Disclaimer

4.1The Service is provided for general informational purposes only.
4.2The Service does not provide, and nothing on the Service should be construed as:
(a)medical advice, diagnosis, or treatment;
(b)advice from a qualified health practitioner; or
(c)a substitute for consultation with qualified health professionals, including your GP, maternal and child health nurse, or paediatrician.
4.3Educational content published on the Service, including guides and articles, is general information only and is not personalised advice. Content relating to infant sleep safety reflects publicly available guidance at the time of writing (for example, from Red Nose Australia and the Raising Children Network) and may not reflect the most current recommendations.
4.4You should always seek the advice of qualified health professionals with any questions you may have regarding the health, development, safety, or wellbeing of any child.
4.5Cubbee does not recommend or endorse any specific Consultant, sleep method, product, or other information that may be mentioned on the Service.

5. Finding and Contacting Consultants

5.1Cubbee reviews new Listings before publication for relevance, completeness, and obvious accuracy, and may request evidence of a Consultant's credentials before publishing them.
5.2Cubbee does not provide clinical accreditation, does not certify, endorse, or continuously monitor any Consultant or sleep method, and does not independently verify professional qualifications, certifications, licences, insurance, or police checks. Credentials shown on a Listing are as stated by the Consultant, and Cubbee makes no representation or warranty about the accuracy of Content published by Consultants, including credentials, pricing, and availability.
5.3You are responsible for making your own enquiries and forming your own judgement about whether a particular Consultant is suitable for your family, including verifying the Consultant's qualifications directly with the Consultant.
5.4By submitting an Enquiry, you consent to Cubbee forwarding the information in the Enquiry to the relevant Consultant in accordance with the Cubbee Privacy Policy.

6. Limitations of Use

6.1You may not do any of the following while accessing or using the Service:
(a)submit false, misleading, or fraudulent information, including in any Enquiry;
(b)use the Service to harass, abuse, defame, threaten, or otherwise violate the rights of any other person;
(c)access, tamper with, or use non-public areas of the Service, or the computer or delivery systems of Cubbee and/or its service providers;
(d)probe, scan, or test any system or network (particularly for vulnerabilities), or otherwise attempt to breach or circumvent any security or authentication measures;
(e)scrape, copy, or republish Content from the Service, including directory content, without the express prior written consent of Cubbee;
(f)interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, by sending a virus to, spamming, or overloading the Service;
(g)use the Service to send altered, deceptive, or false source-identifying information; or
(h)take any action that may undermine the quality or integrity of information contained on the Service.

7. Intellectual Property

7.1Unless otherwise indicated, all materials on the Service, and the website itself, including its design, text, logos, and software (excluding Consultant-submitted Content and third-party content), are owned by Cubbee Sleep Pty Ltd or its licensors and are protected by copyright, trade marks and/or other intellectual property rights.
7.2Reproduction of Content that appears on the Service is prohibited, except where explicitly authorised by this Agreement. This site or any portion of this site may not be reproduced, duplicated, copied, sold, re-sold or otherwise exploited for any commercial purpose that is not expressly permitted by Cubbee.

8. Privacy

8.1Any information you provide to us, either intentionally or incidentally, via the Service is subject to the Cubbee Privacy Policy, which governs our collection and use of your information. You agree that through your use of the Service you consent to the collection and use (as set forth in the Privacy Policy) of this information.
8.2If you include information about a child in an Enquiry or otherwise provide information about a child to us, you:
(a)warrant that you are a parent, guardian, or person with lawful authority to provide that information and to consent on behalf of the child; and
(b)consent to the collection, use, and disclosure of that information in accordance with the Cubbee Privacy Policy, including its disclosure to the Consultant you have chosen to contact.
8.3If you provide any information to us about any other person, you warrant that you have obtained that person's consent to provide the information to us and that the person has reviewed and consents to the Cubbee Privacy Policy.

9. Disclaimer

9.1The information contained on the Service is for general information purposes only. While we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Service or the information, products, services, or related graphics contained on the Service for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
9.2Without limiting the generality of the above, Cubbee does not warrant that:
(a)the Service will meet your requirements;
(b)the Service will be uninterrupted, timely, secure, or error-free; or
(c)any Content published on the Service, including Consultant-submitted Content and educational guide content, will be accurate, complete, or suitable for your specific circumstances.
9.3The Service may contain links to other websites. Cubbee is not responsible for the availability of, or any content or material contained in, or obtained through, any such websites. Any link to another website is not, and should not be construed as, an express or implied endorsement by Cubbee.
9.4Cubbee takes no responsibility, and will not be liable for, the Service becoming temporarily unavailable in the instance of technical issues or any associated problems arising from technical or other associated issues beyond our control.

10. Limitation of Liability

10.1To the maximum extent permitted by law, Cubbee excludes all liability for any:
(a)indirect, incidental, special, consequential, or punitive damages;
(b)loss of profits, revenue, data, or goodwill; or
(c)loss or damage arising from any service provided by, or your engagement of, a Consultant, or from your reliance on any Content published on the Service.
10.2Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement.
10.3To the extent Cubbee's liability for breach of a consumer guarantee cannot be excluded but may be limited, Cubbee's liability is limited, at Cubbee's option, to resupplying the relevant services or paying the cost of having the services supplied again.

11. Suspension and Variation

11.1Cubbee may restrict or block your access to the Service if you breach, or Cubbee reasonably believes you have breached, this Agreement, or if your actions may cause loss or damage to, or otherwise unlawfully harm, any user, third party, or Cubbee.
11.2We may amend these End User Terms from time to time by posting the updated terms on the Service. For material changes, we will give reasonable notice, including by a notice on the Service.
11.3Your continued use of the Service after the updated terms take effect constitutes acceptance of the updated terms.

12. Other Matters

12.1If the whole or any part of any clause of this Agreement is illegal or unenforceable, it will be severed from this Agreement and will not affect the continued operation of the remaining provisions of this Agreement.
12.2This Agreement:
(a)accurately reflects the agreement between the parties as to its subject matter;
(b)records the entire agreement between the parties with respect to the subject matter of the Agreement; and
(c)supersedes all prior representations and agreements in connection with that subject matter.
12.3The failure of Cubbee at any time to insist on performance of any obligation of you under this Agreement is not a waiver of its right:
(a)to insist on performance of, or claim damages for breach of, that obligation unless Cubbee acknowledges in writing that the failure is a waiver; and
(b)at any other time to insist on performance of that or any other obligation of the other party under this Agreement.
12.4This Agreement does not create a relationship of employment, agency or partnership between the parties.
12.5This Agreement is governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that state.
